1. What is the SAFE Act?

President Bush signed into law the Secure and Fair Enforcement (SAFE) Mortgage Licensing Act on July 30, 2008 as a central part of the Housing and Economic Recovery Act (HERA).

Under this act, all non-depository mortgage loan officers in the United States must register in a national database, pass a national exam, pass state exams and accrue a minimum of 20 hours of approved education before engaging in mortgage loan origination activities. Existing loan originators must comply with the minimum standards plus any state specific requirements as the states they originate in demand.

This act sets forth procedures, requirements, education, testing and new standards including mandatory national registration of all depository mortgage loan originators (RMLOs) plus the state licensing of non-depository mortgage loan originators (MLOs), through the creation of a Nationwide Mortgage Licensing System and Registry, known as the NMLS. The SAFE Act is regulated by the Department of Housing and Urban Development (HUD).

"... is designed to enhance consumer protection and reduce fraud by encouraging states to establish minimum standards for the licensing and registration of state-licensed mortgage loan originators and for the Conference of State Bank Supervisors (CSBS) and the American Association of Residential Mortgage Regulators (AARMR) to establish and maintain a Nationwide Mortgage Licensing System and Registry (NMLS) for the residential mortgage industry..."

The SAFE Act requires:

Registration:
Every Mortgage Loan Originator (MLO), depository and non-depository, in the country must be registered in the NMLS. (Dates vary by state)

Unique Identifier:
A unique identifying number is assigned to each MLO. This number is used for all examinations and all education credit reporting. This is also referred to as an Individual ID Number.

Education:
All states must require a minimum of 20 hours of Prelicensing Education (PE) initially and 8 hours of Continuing Education (CE) annually though some have elected to require more or to specify certain subject matter be taken. These requirements vary by state.

National Test:
In order to do business anywhere, you must pass a 100-question national test. Deadlines for this test vary by state.

State Test:
In order to do business in a state, you must also pass that state's specific test consisting of 45-65 questions. Though not every state has state specific education, every state has a state specific test.

State Education (varies by state):
Though the majority of states require only the minimum SAFE standards, some states have additionally opted to require additional state specific education. More on that later...


LAW: The SAFE Act is the federal law (part of the HERA of 2008)

RULES AND REGULATIONS: CSBS and AARMR created the State Regulatory Registry (SRR) to make the rules of how the system would work.

ACCOUNTABILITY: Financial Industry Regulatory Agency (FINRA) build the database to keep track of it all. The NMLS is that database and the SRR manages it.

2. Am I Really a MLO?

SAFE establishes the definition of a Mortgage Loan Originator (MLO) and defines the criteria for who has to be licensed.
    The new definition, in short, includes anyone who takes, or offers to take a mortgage loan application and negotiates or offers to negotiate the terms of that loan for compensation or in the expectation of compensation. Here is the excerpt from the law:
  1. Loan Originator.
    1. In General. The term "loan originator"
      1. means an individual who—
        1. takes a residential mortgage loan application; and
        2. offers or negotiates terms of a residential mortgage loan for compensation or gain;
      2. does not include any individual who is not otherwise described in clause (i) and who performs purely administrative or clerical tasks on behalf of a person who is described in any such clause;
      3. does not include a person or entity that only performs real estate brokerage activities and is licensed or registered in accordance with applicable State law, unless the person or entity is compensated by a lender, a mortgage broker, or other loan originator or by any agent of such lender, mortgage broker, or other loan originator; and
      4. does not include a person or entity solely involved in extensions of credit relating to timeshare plans, as that term is defined in section 101(53D) of title 11, United States Code.
    2. Other Definitions Relating To Loan Originator. For purposes of this subsection, an individual who ‘‘assists a consumer in obtaining or applying to obtain a residential mortgage loan’’ by, among other things, advising on loan terms (including rates, fees, other costs), preparing loan packages, or collecting information on behalf of the consumer with regard to a residential mortgage loan.
    3. Administrative Or Clerical Tasks. The term ‘‘administrative or clerical tasks’’ means the receipt, collection, and distribution of information common for the processing or underwriting of a loan in the mortgage industry and communication with a consumer to obtain information necessary for the processing or underwriting of a residential mortgage loan.
  2. Loan Processor Or Underwriter.
    1. In General. The term ‘‘loan processor or underwriter’’ means an individual who performs clerical or support duties at the direction of and subject to the supervision and instruction of
      1. a State-licensed loan originator; or
      2. a registered loan originator.
    2. Clerical Or Support Duties. For purposes of subparagraph (A), the term ‘‘clerical or support duties’’ may include:
      1. the receipt, collection, distribution, and analysis of information common for the processing or underwriting of a residential mortgage loan; and
      2. communicating with a consumer to obtain the information necessary for the processing or underwriting of a loan, to the extent that such communication does not include offering or negotiating loan rates or terms, or counseling consumers about residential mortgage loan rates or terms.
Certain states have expanded that definition even further by including those who issue mortgage loan commitments or interest rate guarantee agreements to borrowers, whether such acts are done through contact by telephone, by electronic means, by mail, or in person with the borrowers or potential borrowers.

This definition pulls in many loan processors. Check your specific state laws for details.

2b. What if I work for a bank?

Employees... "of a depository institution, employees of a subsidiary that is owned and controlled by a depository institution and regulated by a Federal banking agency, or employees of an institution regulated by the Farm Credit Administration" ...are exempt from licensure through the NMLS at this time but must register. The time lines and the process are still forthcoming. Keep an eye out for changes to this policy in late 2010.

3. How do I create an NMLS account?
For MLOs previously licensed in any state, your introduction to the NMLS will be during what is called transition. When the state you are licensed to do business in begins using the NMLS to manage their MLO data, you will be required to create an account on the NMLS.

There is no cost to create an account, however, if you wish to apply to do business in any state, there is a fee for applying. You can usually find your state specfic fees using the NMLS State Licensing Resource Page. Generally, during transition into the NMLS, a state will offer a window where there is no fee to transition. Transitioning outside this window will incur a fee. So pay attention to all the communications your state sends to you!

Directions on how to create an NMLS account

One of the most important things about creating your NMLS account is getting your "unique identifier." This number will become very important for you as it will be used to track your education hours, exams scores and license status. Every company and branch office will also have their own unique identifying number. All the states, testing companies and education providers will require you to provide them with your unique identifier, which is referred to as your "Individual ID" on the NMLS. In some cases, it will replace your license number with some state agencies.

4. Where do you want to do business?
In the past, state specific education requirements presented a certain bar of entry into some states. Now that education and examinations are becoming more accessible through centralized administration and approval there may be opportunities to originate in states that previously were out of reach. Almost every state has written and passed new licensing legislation in 2009. It is important that you update yourself on the new responsibilities and requirements of each state you want do business in. You can get some information from the state information on the right hand side of this page.

Not all states have announced their new licensing requirements but most have begun implementing their SAFE Act laws and regulations. As these states begin clarifying what is required to originate in their state, new state specific education will be submitted to and approved by the SRR. Keep an eye out for new state-specific curriculums as they become available.

5. Does education I have taken in the past count?
If you currently hold a license to originate mortgage loans in a state that requires you to take approved prelicensing or continuing education courses, then you may already have completed some, if not all, of your 20 hours of nationally required prelicensing education (PE). To find out how much, if any, of your previously taken education can/will count towards your national requirement, please contact the regulator of the state(s) you are currently licensed in.
NOTE: Not all states are awarding credit for past education and of those that do, not all will be able to transfer that credit to the NMLS before certain state deadlines. See the state listing to the right for certification and requirement information.

7. How do I take my classes?
You need to embrace the fact that all PE classes are live classes. We offer two delivery modes:

Live Classroom - The student and the instructor are in the same location.

Live Classroom Equivalent - Via a live stream over the internet, the student participates in a live classroom offering from a remote location.

9. I'm ready. How do I take my exams?
All of your fees for licensing, renewal and exams have to go through your NMLS account. So even though the NMLS does not give the exams, you do have to pay for them through your NMLS account. Before you begin this process, it is recommended that you download and read the MLO Testing Handbook.

The process is:
  1. Pay
    Log into your NMLS account and click the Professional Requirements tab, then click Testing on the top of the page. Then click on Test Enrollment. You will choose your states and/or the National component and pay for your examinations. You will receive a confirmation email once your payment is received.

  2. Scheduling
    Once you have paid for your exams and gotten your confirmation email, you can then choose where you want to take the exams. Go to the NMLS Testing Resource Page and use the links there to decide what testing center is the most convenient for you. One you have decided which center you want to use, visit the website of the testing company that runs that location to schedule your exam time(s).

  3. Take your exam(s)
    You will receive email confirmation from the testing company once you have scheduled your test time(s). They are there to make sure you are who you say you are. There is no need to bring your MLO license or your certificate of completion from an education course. You will have to show two forms of ID, one that has your picture (ie: driver's license, passport, etc.), to the proctor on site at the testing center. You have three hours to complete the national component and two hours to complete any state component. You must score 75% or better to pass. Once you have completed your exam you will be given a score card by the testing company as proof of your passing and they will submit your scores to the NMLS. If you do not pass any exam you must wait 30 days before retaking the exam and you must pay again. If you fail four times, you must wait 6 months before taking the exams again. You may not bring anything into the exam. Any personal items you bring into the testing center will be put in a locker and held by the proctor until you complete your exams. Scratch paper and a calculator will be given to you at the testing center and collected from you before you leave.

10. How do I apply for a license?
Initially, whether you have been doing business in the mortgage industry for 20 years or 2 days, you will have to complete an application, called an MU4 form. This is a detailed application and will take you 20-40 minutes to complete. We recommend having a resume or some other helpful document available while you complete the application as it will require you to input your last ten years employment and residential history. Once you have completed your MU4 and are granted a license, you do not have to complete it again! You will be able to modify/update your information as needed and attest to its accuracy and use the same information for all the states you apply to.

Once you are licensed, you can then associate yourself with the broker or lender that you work for so they can notify the NMLS that you are originating for them. It is important that the NMLS know who is originating for what company and where.

11. How do I renew my license?
In order to renew your license, you must have completed all of your required education in the appropriate topics. Those credit hours are reported to the NMLS by your course provider. Once you are inside your renewal window (November/December) you can log into your NMLS account and complete your renewal.

There are, basically, three steps to renewing:
  1. Attestation - Confirming you are who you say you are and that you have completed all the education required to renew.
  2. Review - Looking over all your details and confirming that your information is up to date and correct.
  3. Renewal - Paying your appropriate renewal fees.

12. So what now?
As a condition of renewal, you will be required to take a minimum of eight hours of approved NMLS continuing education each year prior to December 31. Some states will have requirements above and beyond this minimum standard. Title V of the Housing and Economic Recovery Act of 2008 (H.E.R.A.), “the SAFE Act,” became effective July 30, 2009 and mandates that state-licensed mortgage loan originators meet certain minimum requirements for licensure.

States were required to enact SAFE laws that will bring their mortgage loan originators into compliance with the SAFE Act no later than December 31, 2010.

Current and former DRE licensees may request certification from the DOC. MLO applicants who apply for an MLO endorsement with DRE will have their pre-license education requirements certified by DRE.

CRIMINAL BACKGROUND CHECK
All applicants must submit fingerprints through NMLS for a criminal background check by 9/15/2010 in order to be issued a MLO license endorsement by 1/1/2011.

CREDIT REPORT
All licensees will be required to authorize a credit report through NMLS between October 2010 and March 1, 2011.

SPECIAL NOTE - EDUCATION REQUIREMENTS
The Louisiana Legislature recently passed House Bill 335 which updated its SAFE Act requirements. The changes, which go into effect Aug 15, reduces the number of hours for pre-licensure education from 24 to 20 and removes the requirement for four hours of the education to be NAMB or MBA approved. Additionally, the law reduces the number of hours of annual continuing education from ten to eight.

As mentioned, the changes go into effect Aug 15th which means the existing requirements remain in effect until then.

All new applicants on or after 1/4/2010 must complete 20 hours of NMLS approved pre-licensure education, including 2 hours of WV specific.

Existing licensees prior to 7/1/2009 must complete 20 hours of NMLS approved pre-licensure education, including 2 hours of WV specific, by 10/31/2010, unless the licensee has completed at least 20 hours of state approved education prior to 12/31/2009.

Licensees approved between 7/1/2009 and 12/31/2009 must complete 20 hours of NMLS approved pre-licensure education, including 2 hours of WV specific by 1/31/2010.

State approved courses will no longer be accepted after 12/31/2009.

CONTINUING EDUCATION
All licensees must take 8 hours of NMLS approved continuing education, including 1 hour of WV specific, in 2010 in order to renew for 2011, unless PE was completed in 2010.

SAFE MLO TEST
All licensees approved before 7/1/2009 must pass the National Component of the SAFE MLO Test by 10/31/2010.

All licensees approved on or after 7/1/2009 must pass the National Component of the SAFE MLO Test no later than 1/31/2010.

All licensees must pass the State Component of the SAFE MLO Test by 10/31/2010.

CRIMINAL BACKGROUND CHECK
All licensees must submit fingerprints through NMLS for a criminal background check by TBD.

CREDIT REPORT
All licensees will be required to authorize a credit report through NMLS between October 2010 and March 1, 2011.
